Terms of Service

These Terms govern access to the Dundas Print website and the sale of products and services by Dundas Print Canada Corporation. By using the site or placing an order you agree to these Terms and to any guidelines posted on the site. If you use the site for a business you confirm you are authorized to bind that business.

Every offer, order, and agreement made through the site is subject to these Terms. Any customer terms are rejected unless Dundas Print agrees in writing. Prices and descriptions may change without notice. If the listed price differs from the actual price we will notify you before processing the order. Prices shown are for merchandise only and may exclude setup fees, art changes, shipping, taxes, rush fees, and other charges that will be communicated before processing.

To place an order you must create an account and are responsible for all activity under it. Dundas Print may refuse any request or close an account for breach of these Terms. Site content is protected by copyright and may be used only to prepare, evaluate, and order Dundas Print products. You must have the necessary rights to any materials you upload. You authorize Dundas Print to copy, modify, and use your uploaded content to fulfill your order and to market products and services to you.

Sale by proof and sample

Orders are produced to the approved digital proof and, where provided, the approved physical sample. Goods conform to contract if the delivered items match the approved proof or sample in all material respects. Once approved work enters production all sales are final.

Acceptance on receipt and claims

You must inspect shipments at delivery. Visible damage must be noted before the shipment is moved from its received condition. Claims for concealed damage must be submitted within forty eight hours of delivery with clear photos of the unopened carton, opened carton, inner packaging, and affected items. Claims without timely notice and complete photo documentation are not eligible for review.

Transfer of title and risk

Title and risk of loss pass to the customer upon delivery to the carrier. Once goods are delivered and accepted in good condition, responsibility for handling, washing, storage, transportation, and use transfers to the customer.

Manufacturer documentation and certifications

Some products may include manufacturer supplied documents such as food contact statements or third party test reports. These are manufacturer representations for the specific model and production lot identified in the document. Dundas Print does not modify or extend those representations. Copies are available on request. If a certificate or report is not explicitly identified on your quote or invoice for a specific model and lot, no claim is made that such documentation applies.

Use statements

Dishwasher safe and microwave safe statements, when available, apply only where the manufacturer has issued written guidance for the named model and lot and only under the conditions described by the manufacturer. Absent model specific written guidance, no claim is made regarding dishwasher or microwave suitability. Cosmetic wear from washing, abrasion, stacking, or temperature exposure is expected over time and is not a defect.

Limitation of liability

To the maximum extent permitted by law, Dundas Print is not liable for incidental, indirect, or consequential damages, including lost profits or business interruption, arising from the site, the products, or post delivery handling, washing, storage, transportation, or use. Dundas Print’s total liability relating to an order is limited to the amount paid for the affected goods.

Indemnification

You agree to indemnify and hold Dundas Print harmless from claims, losses, costs, and liabilities arising from your uploaded content, your breach of these Terms, or your handling, washing, storage, transportation, or use of products after delivery.

Governing law and venue

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Any legal action shall be brought in Ontario. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
